Human rights in sharia and law

The subject of human rights in Sharia and law is an important subject and combines two dimensions: Islamic and modern legal. It can be clarified as follows:

First: human rights in Islamic law

Islamic law has consecrated the principles of human rights over 1400 years ago, through the texts of the noble Koran and the Sunnah of the Prophet, emphasizing human dignity and justice. The most important of these rights:

1. Life on the right

. A person is free in his life, and it is not allowed to kill him unfairly.

• The all-powerful saying: “and does not kill the soul that God has prohibited except by the truth.”

2. Freedom

Freedom of belief, expression and mobility includes.

The Prophet ﷺ said: “There is no constraint in religion.”

3 .. Justice and equality

Equality between human beings in rights and duties, without distinguishing color, sex or tribe.

The all-powerful saying: “O you who believe, be the forces of the premium martyrs of God.”

4 .. Human dignity

Each person has dignity, and it is not allowed to insult or torture.

• The all-powerful saying: “We have honored Adam’s children.”

5. Women’s and children’s rights

The right to education, inheritance, consent marriage and protection against violence.

• The messenger ﷺ is interested in the rights of orphans and women in society.

6. The right of property and money

Maintain public and private properties and prohibit theft and fraud.

Second: human rights in modern law

Modern law was based on the global principles of human rights which began to crystallize after the Second World War, in particular:

1. Universal Charter for Human Rights (1948)

Each human being is equal to dignity and rights.

It includes the right to life, freedom, education, work and health.

2. Civil and political rights

Freedom of expression, right to a fair trial, political participation and freedom of belief.

3. Economic, social and cultural rights

The right to education, health, social security and decent work.

4. Protection of women and children

Laws against domestic violence, child law to protection and good growth.

5. Implementation mechanisms

National and international shorts, human rights organizations and international treaties.

Third: the relationship between sharia and law

There is a great consensus between Islamic law and modern law in most human rights, such as the right to life, dignity and justice.

Certain differences appear in applied details such as women’s rights, freedom of expression or criminal sanctions, where sharia is trying to achieve a balance between rights and duties according to moral and religious principles.

• Many modern Islamic countries adopt the mixed legal system that combines Sharia law and international civil law.
